The Alabama Legislature concluded its session on June 6, 2023. Despite Alabama being one of just 19 states that still enforces incarceration for individuals found with small amounts of cannabis, there were some advancements made to decrease the number of arrests related to cannabis use.

This year, Senator Bobby Singleton (D) reintroduced a cannabis decriminalization bill (SB 42), but it did not progress beyond the committee stage. Nonetheless, a new bill, HB13, allowing cities to implement a "Cite and Release" policy for certain minor offenses, including, in certain cases, personal cannabis possession, was approved by the legislature and signed into law on June 20, 2023.


Representative Christopher England's (D) HB 13 empowers municipalities to adopt a "Cite and Release" approach for nonviolent misdemeanors, potentially encompassing personal cannabis use, although the law does not provide a specific definition for personal use. This allows significant discretion for the arresting officer.

During the conference committee discussions, HB 13 was revised to specify that the cite-and-release policy can only be applied to controlled substance use or possession, including cannabis, if authorized by local legislation. In accordance with Alabama law, this necessitates the approval of a local bill by the entire local delegation of state lawmakers, as opposed to a municipality's self-passed ordinance. This addition was introduced by Senate Judiciary Committee Chair, Will Barfoot (R), with the explicit intention of preventing Montgomery from implementing this policy, primarily due to concerns about cannabis possession. The only exception is Tuscaloosa, which was exempted due to a pre-existing decriminalization ordinance enacted prior to May 1, 2022. Collaboration with advocacy groups, led by the Southern Poverty Law Center, is expected to assist municipalities in initiating this process.

While HB 13 enables cities to avoid detaining individuals before trial for minor offenses, it does not eliminate the possibility of post-conviction imprisonment for cannabis-related offenses or the associated criminal record. We urge you to contact your legislators and emphasize the urgency of prioritizing cannabis decriminalization. It's high time to put an end to these severe penalties and allocate law enforcement resources toward addressing more serious crimes.

Is Cannabis legal in Alabama?

Currently only CBD and medical cannabis are legal in Alabama. CBD laws in Alabama fall in line with USDA regulations from the 2018 Farm Bill. Cannabis patients in Alabama have reported limited availability of CBD products.


Alabama's Governor signed a bill in May of 2021 that would provide  access to medical cannabis for Alabama's citizens with one of 18 conditions which include intractable pain. The patients that were surveyed said they have noticed no notable changes to access since the passage of these new laws, and there is currently no official start date for patients to access medical cannabis.
